  • Late deposit protection

    Hello,

    Started an AST years before 2007 deposit protection rules were introduced. However, most recent renewal was after 2007

    Never bothered protecting the deposit but as I now need to serve section 21, I understand it must be protected otherwise s21 is invalid.

    So I protected it a few days ago. Is it now ok to serve s21?

    Also could someone please post a general template letter for letting tenants know their deposit is protected.

    Have you provided the tenants with the prescribed information required by the scheme?

      Not yet, I need someone to post a template letter that I can fill in and post.

      Deposit is held with DPS online but they haven't provided any letter to print.

        Go to their website and print it out.

            Fair enough, didn't know about that document!

            Thanks for your help, I appreciate it.

            EDIT: Have just read the document and it requires tenant signature. Is this necessary for S21 to be valid because I know this tenant won't sign anything?

              The tenant needs to be offered the chance to sign it. However, he doesn't have to. Weird I know. It would be wise to have proof of service though - just in case.

              It is wise NOT to serve the PI and s21 on the same day, as PI has to come before s21 and if they are the same date there is room for uncertainty.
