    Rent arrears

    In an AST contract,would it be a good idea to insert a clause that allows rent arrears to be taken from the deposit should the need arise or are there any potential disadvantages by doing this?

    Just make sure that that clause is restricted to landlords rights. If not, you are making it legitimate for the tenant to not pay the last months rent and tell you to use the deposit (thus leaving you with no deposit for damages).

      Thanks Snorkerz, I think I shall better leave the clause out altogether. After all the Tenant has a Guarantor.
