    Section 21 expired but tenants have not left, whats next?

    Hello,

    Sorry if this has already been covered elsewhere I have searched the forum and cannot find the answers, excuse my ignorance but I have never had things go this far in 10 years of renting.

    I served my tenants a section 21 notice which expired on 14th August and they have still not left as they cannot find a landlord that will accept housing benefit (at least thats what they are saying) anyway the reasons don't really matter. I need these tenants to leave, could someone please explain the next process to gain possession? With what forms I need to fill out etc.

    I did speak to someone who said the accelerated possession can actually take longer? Is this the case? Whats the best course of action?

    Also they owe me some rent which they are saying to take from the deposit but of course if there is damages/cleaning etc then I will be out of pocket (the deposit is in the DPS scheme)

    Any advice would be greatly appreciated

      Accelerated possession is marginally quicker than 'non-accelerated' because there is not normally a hearing. That does not mean it is quick http://www.landlordlawblog.co.uk/201...ion-procedure/

      As your tenant is on benefits, I wouldn't lose any sleep about missing rent etc, because you are unlikely to be able to recover anything that sn't covered by the deposit or (if you have one) guarantor agreement.
