    Can choose 2 answers in Section 4 N5B?

    Hi,I have problem with section 4 For N5b. It seems a) and b) both match my situation. Can I tick both?

    Situation: My tenancy agreement is a periodic short hold tenancy. The tenancy agreement expired may 2011. I didn't sign a new agreement with the tenant. The tenant continues lives in the property and pay rent. Now I need the house back for myself. I served the tenant section 21 and gave him 2 months notice. The tenant will not move and said he will stay till the court give him an order.

    You don't need to choose an answer, all 3 apply. You delete all of section 5.

    FWIW, tenent is totally within their rights to take this stance - as inconvenient as it may be. He may not even leave if you get a court order, you may need to get bailiffs to enforce it.

    Have you verified that your section 21 notice is correct?

    If not, please answer:
    1) What date did the tenancy begin?
    2) How long was the fixed term - was there an end date?
    3) Was a deposit paid?
    4) If so, when was the deposit protected, and by whom?
    5) When was the section 21 notice served?
    6) Was it served under section 21(1)(b) or 21(4)(a)
    7) Do you have proof of service
    8) What expiry date did you give (exact wording).

      i am not so confident with the other sections. Can you help check if they are correct.
      Section 2. Deleted
      Section 3. Date tenancy signed
      Section 4. Delete the "[first]
      Section 5 & 6. Delete
      Section 7. The date I issued Section 21 (4)(a), Served by HAND, expired date is two months after issued date.
      Section 7B: Delete (a) and (b)
      Section 9. Delete

      The deposit submited to DPS is 2007 when the first 12 months tenancy signed. When we renewed the current 3 years tenancy, I did not update the information to the DPS. But the deposit account is still active. The deposit is still hold by DPS. How can I prove this?

        Click on the 'documents' link (top left) and you will find a completed n5b with answers to compare with your own. That site "Landlordzone" is different to "Landlordzone Forum" so you will need to re-register.

        With regard to the DPS, just provide the certificte from 2007 - it will be fine.
