    Changing date of rent due

    Hi,
    Is there a specific form that should be used for this, or is just an agreed letter in writing signed by all parties acceptable.

    Why would you want to do this?
    Is the tenancy fixed term or periodic?

      You can change the day the rent is paid but it doesn't alter the day on which it is due each month and will not alter the date on which it ends.

        A tenant wants to change the date that her rent is due, which is different from the one on the ast, which isnt a problem but which would be the best way to do this, just in writing etc?

          Does your tenancy agreement give a specific date for rent to be paid on or does it state rent needs to the in advance of a specific date?

            I would not red changing due rent dates as stipulated in orig AST as it unlikely that T is seeking earlier payment dates. As LL you can decide to accept late payments but you should make it clear to T that rent is due prescribed date and subsa action will be based on this date.

              I would write to the tenant something along the lines of; "rent is paid monthly as per our existing agreement. As such, rent will always legally become due on the 25th as that is the monthly anniversary of your moving in. If you wish to pay on a different date then that is your choice but you must be aware that late payment may carry consequenses"

              It is Sunday morning, my brain isn't too good, so you may have to tidy up the English!

                It's due because the contract says it's due on that date, not because it's the anniversary of move in date.

                  Touché - perhaps "as that is the monthly anniversary of your moving in" should be missed entirely. I did say I wasn't fully awake!

                    I’d propose an increase in line with the contract term.
                    And don’t sign a new agreement, just let the current agreement roll into a periodic tenancy.

                    If you’ve paid them for a service they are refusing to provide, yes.

                    I’d start by invoicing the tenant company for the damage though.
                    You have two separate claims and it’s unlikely that the agent would bust a gut to do the job you want them to do....

                    I think you should check that again.

                    Note that the notice doesn’t bring the tenancy to an end, so you can issue your own notice after the fixed term ends, or simply leave before the end of the fixed term, if...

                    The quote you gave from the contract does not give a maximum %%, it just say '' in line '', that could mean it goes up a little or a lot..... it seems a bit vague. In the end if this property has become too expensive for you then in time you may have to move to somewhere cheaper (if they exist !!)....

                    Do not let this get out of hand, increase the rent by the amount you say every year, and i would go for even more, have an honest conversation with the tenant, if she cannot afford it then it maybe time for her to move on, if you let it get too far behind then you will never catch up with this tenant.........
