T has missed her last two rent payments (£700), do I have to wait until she misses next months rent before I can send her a FINAL DEMAND

The rent is paid 4th of every month and also paid in advance her last payment was 4th April, she has been a T since 4th February, and in that time she has been a right pain. We dont want her as a T and she wants to leave but still has the keys!

We understand we will have to evict her but are unsure if we can evict now or do we have to wait until 4th July before we can see a solicitor to serve eviction notice and start court proceedings to recover lost rent etc.

As wa have no idea how to fill in the required forms we will have to use a solicitor, so does anyone know what the approximate costs will be.

The deposit is protected and is months rent (£350) the property is in England.

You need to use the section 8 process to evict.

Providing your tenant owes you at least £700 then you can serve a section 8 notice today citing grounds 8, 10 & 11. Ground 8 is a mandatory ground, which means that when this gets to court, if she still owes at least 2 months rent then the judge has no choice but to evict.

There are a number of firms who advertise on here to handle the complete eviction - but expect the cost to be iro £1000 inc vat for the full service. I would advise you not to use a general 'High Street' solicitor as (unless they are specialists) their knowledge of Landlord and Tenant law can be patchy. It would not be the first 'solicitor' eviction we had heard of that fails due to a simple error.

If T did not pay rent due in advance on 4th May, and also did not pay rent due on 4th June, then as from 5th June you may cite the mandatory ground 8 (i.e. at least two months' rent owing and unpaid) in a s.8 notice. You can also use the discretionary grounds 10 & 11. After the notice expires you can apply for possession. If the T still owes at least two months' rent at the time of the hearing, the court must make a possession order.
