    Need help completing Tenancy Agreement!!

    Hi

    Please bear with me as this is my first time going it alone without an agent... I have purchased an AST from oyezforms and have some questions about filling it in:

    1. Under PARTIES it reads: 'THE Tenant'.... I have joint tenants which I would like to put on the same AST, would I have to edit form to read 'THE Tenant(s)'? Either way, do I just list the names or do I put [name] and [name]?

    2. The last page of the document has 'DATED' at the top, I assume this is the date that the tenants actually sign the agreement- which will be a few days prior to move-in?

    3. Just below 'DATED' there is a gap for an entry then it reads 'and' with another gap for an entry, is this looking for landlord/tenants names again?

    4. There is no mention of the deposit in the agreement, surely this needs to be in there?

    Hopefully someone will be able to understand my ramblings...

    Any help would be most gratefully appreciated.

    I am loving this site and have learnt a lot but couldn't find anything on this -don't know if anyone has ever asked such basic questions!!

    It is advisable, maybe for future, to hire a solicitor to draw up a good AST, specific to your needs and to the property.

      Yes MrShed, I think you're right. I did get the impression from the forum that there was no point doing this as it is such a standard and basic form.

        You really need on-hands help rather then asking here as you are clearly too much of a novice to be doing this. You are heading for trouble if you don't know how to complete a tenancy agreement. By the way you could have downloaded a decent agreement from the internet for free and then amended it to suit your needs. The Oyez form will only give you the basic agreement and is not nearly good enough to make sure your interests are fully covered. There are much better ones (my opinion only) if you really want to part with your money; but to try to answer your questions:-

Put all tenants full names and their previous address, such as Mr John Smith of (address) and Mrs Susan Brown of (address) - it doesn't matter if it says tenant or tenants.

It can be dated in advance but I don't recommend you put any dates in until the tenant has signed it first just in case th move in date is put back so as not to mess up your form: remember too you have to advise the tenant they should consult the CAB or a solicitor before signing it so they need to be given a reasonable time to do so (I won't go into the details as I would be here foreever)

        4. There is no mention of the deposit in the agreement, surely this needs to be in there? Defintely, and it needs to be stated whether you hold it as landlord's agent (even if there isn't an agent), or stakeholder - (read my article under artices in the home page for an explanation)

        Right! As you can now see from my comments you need to know much more than you are capable of understanding. My advice is to ditch the one you have any buy a CD from the National Association of Estate Agents (NAEA) or the Association of Resdiential Letting Agents (ARLA) which will be so good you never would have known one existed. (ARLA will be absorbed next year under the NAEA umbrella, but retain its identity) It might cost you £100 but you can use it over and over agains without any further cost, and it tells you where you should complete gaps, gives all the explanatory notes the tenant should have in advance, and will save oyu a lot of money in the long run. You don't need to be a member of either to buy one. The NAEA one can be obtained by phoning Adam Rollins on 01926 417753 (direct line to him) and you can pay by credit card.

          Speaking as a tenant I would not sign the ARLA contract as it has the landlord opting out of doing repairs e.g. to appliances, see http://www.landlordzone.co.uk/forums...ead.php?t=3795. It isn't a contract to get good tenants in or to maintain a good relationship with the tenant. My letting agent uses the RICS contract which is excellent.
