I have had a tenant at my property for 4 years, for the last 2-3 years her rental payments have always been hit and miss. Most months would be late payments with £100 short one month, £200 less the next but then £100 extra the next month etc so I thought as soon I was still getting the rent, albeit not how I wanted, I let her stay although I sat down with her numerous times asking her to sort it out.
Fast forward to a couple of months ago... I told her I wanted to talk to her and agreed a time. Went around and said in a nice way that enough is enough and I need regular payments and arrears to be paid off or we will not be renewing the 12 month policy which was ending in around 6 weeks time. We came up with a a schedule of how she could pay the money back and all seemed fine. Although she didnt keep to it, I got £100-£200 here and there and that was it.
Coming to end of agreement she rang me asking me to go around which I did, at which point she told me that she was unable to afford the rent let alone the arrears. I told her then that I will give her 1 months notice to leave the property and that she would pay off teh arrears after she had moved out also, she seemed happy with this.
I went back a day or 2 later with a friendly letter written by myself saying this is 1 months notice and I also issued a Section 8 (which I downloaded of the internet) with a date of 1 month also. I asked for a signature to say she had got it but she refused (I did take my brother as witness & she called her next door neighbour round also for some reason).
I had rang her a couple of times over the month to see if arrangements had been made to leave to which she said they had been. Anyway, the 1 month notice for her to leave the property and start date for section 8 was up today and I spoke to her this morning and she is essentially saying that she has nowhere to go now so isn't moving out and that she needs more time to sort something out. She left it essentially saying that I would have to go through the courts to get her out.
What can and should I do? I have heard many stories about avoiding the courts and how it is very costly but I cant see her paying any rent or actively looking for somewhere to move to either.
