    Notice & New contract in one???

    Any advice would be appreciated...

    My landlord has served me notice (section 21) in line with my rental dates, all correct I believe. In the same envelope he has also offered me a new contract at an increased rent. Doesn't this invalidate the section 21?

        This is one of the two ways that your landlord can increase the rent. If you are prepared to accept the increase then sign the new AST and pay the increased rent. Your occupation of te premises can then continue uninterrupted. If you aren't happy, discuss same with landlord and if a compromise is not possible then prepare to move out. At least you do not have a greedy letting agent demanding a fee of something like £100 as well to renew the tenancy!

          If the s21 is worded correctly and your landlord has protected the deposit and given you information about which scheme is holding it there's little you can do unfortunately.

          To get an idea if the new rent is reasonable have a look at local estate agents to see what similar properties are going for. You should then discount that price by a fair amount (at least 10%) to account for the extra fees the landlord would have to pay when a new tenant moves in. You may want to take off a bit more depending on how active your local rental market is, to accommodate the risk the landlord may face when trying to get a new tenant in to pay the rent.

          Once you've worked out a price your starting offer should then be pitched lower, as with any negotiation.

                I think the company has an obligation to get an actual meter reading at least every 2 years - during covid they accepted photos in place of sending in a meter reader - you could try getting them to accept at least some of the blame.

If your tenant came along with a whole load of other builders quoting for the same job then what are the chances you would pick him as being the very best bet ? Just because his is your tenant does not make him the ideal choice..... if anything it...

                Also consider the date of the EPC - the assessment has change a lot since they came in 10 years ago and and old assessment may be out by quite a lot of points or may have had work done that is not reflected in the EPC.

                Some upgrades are easy - LED light bulbs, loft insulation; others much more tricky - floor insulation; party wall insulation; some are just very expensive - external wall insulation.

                The EPC assessment is not fit for purpose so it is really tricky to know what to do. What I wouldn't do...

                Thanks for the reply. This is a different case.
                The defendants are asking to set aside. Any paperwork sent to me has come from the courts only and not them.

                I've provided the defendants and the court with paperwork in preparation for the hearing to set aside....

                I still can't think of a better thing to invest in even given all the new regulations. The lessons i have learnt are:-
                1) Never let to people on benefits.
                2) Don't over leverage your borrowing.
                3) Have access to spare funds for unexpected things like a new boiler being required or...
