Allowed relative to use flat - no AST

Hi

I allowed my Aunt the use of my flat when I was going away for a year. She had just separated and had nowhere else to go. I told her as long as she paid the bills then there was no need for any rent.

She set up a standing order to my bank account called - [her name] Rent.

Now the money has stopped and she is making noises about not moving out.

No AST and what she pays is about half the rental value and that doesn't include the bills she would be paying.

What is my next step?

Even though there's no written Letting Agreement, I think that there is an [oral] AST.

Largely depends on what you want to achieve, but assuming you want rent, then you need to discuss some sort of payment plan with her, and perhaps formalise the relationship with a written AST.

If you want her out, then you'll need to evict under either S21 or S8 (or both).
