    S21 dates

    Have read the FAQs with regard to S21 dates for a periodic tenancy and just wanted to be sure that I had added them up right, please.

    Commencement of 6 month AST 22/03/10 - 21/09/10 so last day of the tenancy period is 21st of the month so if S21 is served 28/03/11 expiry date is 21/06/11 NOT 28/05/11 as stated have I finally got this right?

      Literally, yes; fixed term expiry was indeed 21 September 2010, so SPT expiry is every 21st (e.g. 21 June 2011).
      BUT Notice under s.21(4)(a) needs to require possession "after 21 June 2011".

        Thank you for your advice it would appear silly of me to ask really anyway as my deposit is not protected so in this case the notice isn't valid anyway but I just wanted to clarify for myself if LL still believes he can issue for possession after 28/05/11 as he seems to think. This notice was served to my expartner on the street by his (my LL sorry) agent and was open and not addressed to me anyway so I could argue anyway that I never received it.

          It would be right if rent were payable monthly, but according to a previous thread your rent is payable weekly, so the tenancy periods would run weekly as from 22nd September 2010, e.g. first period Wednesday 22nd September - Tuesday 28th September.

          LL's s.21 notice served on 28th March 2011 should expire "after [Tuesday] 31st May 2011".

            Thanks for that Westminster thats something I forgot to mention so thank you for that either way the date is still wrong, Its just that I read somewhere about weekly payments meants that you counted 7 days after the date of the last date of the tenancy period.

              Interesting, but it sounds like the university is definitely exceeding its authority and a clued up student could easily challenge any sanction they tried to impose.

              That's post Covid restrictions and would probably include most of the last of the Covid backlog.

              I think there's some date confusion above. If your 6 month fixed term tenancy began on 9 December, then it ends on 8 June.
