  • Tenancy Agreement - buying "off the shelf"

    Wondered whether anyone has used these "off-the-shelf" Tenancy Agreements?

    My problem is that I currently have a property up for sale on a 'sole agency' contract, as it's not selling I looked to letting with them as well. They want to take the first months rent for every new tenant or renewal of contract plus 15% fully managed monthly fees. I think this is ridiculuous and therefore advertised myself for a tenant. I have someone interested and am now in a panic as to what I need to do reference contracts, insurance, credit checks etc.

    Is it a bad idea to do this without an agent?

    Any advice will be gratefully appreciated.

    your right its robbery. letting agents wear suits instead of striped tops, face masks and swag bags so think we wont realise theyre modernday highwaymen!
    an off the shelf ast agreement should meet all your needs. if feeling bit daunted get your solicitor to draw up your first or recomend a solicitor that is specialised in letting law.
    I use Letsure to do my checks and they are fab youll find them easy to fill in and costs are very good. dont forget to get each aplicant to pay for there own referencing. less likely to waste your time if its at their cost.
    most inportant dont panic and ask as many questions here as you need. stick with it.

      Disclaimer:I have over 30 years experience in housing(both social and private) as an EHO and Building Surveyor.I am also a certified expert witness having spent the last 15years working in housing litigation.The advice I give is from experience in working for various Local Authorities and how the law is interpretated.Housing Law is a minefield and is continually being amended if in any doubt you should consult a solicitor or someone of equal legal standing.

        I bought a Landlords' Association one off the internet, which is fine to a degree, but it's supplied as a PDF, which is very difficult to amend, to take into account specific circumstances.

          As I am always posting, solicitors will go to http://www.oyezformslink.co.uk for such forms and you can as well where they are available at low cost. The main website of this board has an excellent tenant application form which it is recommended you use. Be careful to get references for your potential tenants, particularly landlords references. When you have received them, ring up the referee to make sure that the reference is genuine - I'm not joking, forged references have been known! Finally, if you can't afford Adobe Acrobat to take a pdf file to bits and reconstruct it in an alterable form (and who can?) Print the file out and scan it with a scanner. With a bit of luck the scanner software includes an OCR function (optical character recognition). This will produce a .doc file which, with a bit of work you can turn into a version of the original, but now alterable form.

            Many thanks. Actually, I do have Acrobat (don't tell anyone, but it was a fiver off Ebay) but with locked files even that doesn't help. I did download one of the many utilities that are claimed to allow editing of pdf files, but it was so crude as to be virtually useless.
