    Can I issue CCJ for unpaid rent after S21 issued?

    Hi. I decided to issue a S.21 instead of a S.8 because I live abroad and if I understand correctly, the S.21 process is simpler. However, there are rent arrears predating the S.21 and these continue to accrue. Can I continue with the S.21 and go to Court separately to recover unpaid rent (ie CCJ)? My tenant is in a full-time job so I hope I can get an attachment of earnings. Many thanks.

    Yes. The two are independent. Not every s.8 case involves arrears; and s.21 is entirely procedure-based (not fault-based).
    And, of course, L can sue T for unpaid rent even without serving under either s.8 or s.21.
