If I wish to sell can I evict T?

After evicting the last lot of non paying tenants, we know find ourselves back in trouble.

Present tenants moved in May this year, The rent has been late every month, We've put up with endless excuses as to why the rent is always late. Now they have emailed to say that suddenly neither of them is working. yada yada

As they have not even been there six months can I give them one months notice if I tell them I wish to sell up?

We want to off load the property and obviously want this lot out if they can't pay up. Or are we back down the court route?

Cheers for any advice folks, ya came up trumps before

Without grounds under s.8, you cannot evict the Tenants before the end of the fixed term and even then you have to give 2 months notice that you want possession (s.21). If they don't leave after the 2 months notice expires, you will have to go to court.

edit - assuming the tenancy is an AST.

In a word, no - wanting to sell up is completely irrelevant to any repossession proceedings.

check if they are on (what used to be called) housing benefit. If so and if they are 8 weeks behind in rent it must be paid by the council directly to you. You will have a bit of a battle getting the council to give you the info but insist!
