    Landlord left mess and damage after fitting new bathroom

    Hi,

    We have been on holiday for a week and in that time we agreed that the landlord could put in a new bathroom. We have come back to mess everywhere. There is brick dust everywhere, in all the rooms over everything. Everything in the kitchen has to be washed, all soft furnishing also as its making us cough. He has moved things and not put them back. He has caused damage to a piece of our furniture by putting a piece of soap from the bathroom on it. He has made no attempt to sweep up outside (there is rubble and broken bits of mirror on the floor. He has piled rubbish out the front which won't be taken by the bin men because its not in bags.. we'll have to do that. He also cut down stuff in the garden, moving all our pots into the middle of the lawn and not putting them back. I have spent 30 mins raking the garden as there are cuttings everywhere.

    To top it all off, his uncle who fitted the bathroom stayed in our flat while we were away and used the kitchen etc. He didn't ask us if this was ok. This is our home where we pay good money to live here. Is any of this acceptable? The house was not left in the condition we left it in and it has taken 5 hours of cleaning so far. Is there anything we can do about this? We are upset and angry.

    The simple answer to your question is, no it is not acceptable.

    What you can do depends on your relationship with your landlord. Obviously your first question should be when will anyone collect all the debris he has left in your garden?

    Then, you need to list the issues you have here, and make it clear to him that you expect compensation for the damage to your property and the extra work that you have had to do. I would aim for an amount equal to one weeks rent.

      Sorry to read your story. Does your landlord know what state the place was left in?? (?You've written to him??). Could be Uncle said everything was done OK, LL doesn't know there's a problem

      Ask landlord for a copy of the (not sure what the official name is) Electrical installation certificate...

      If it is "Uncle" doing it are you comfortable he was suitably qualified if any electrics (eg new light, shower pull-cord) were installed and are they safe??

      I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...

        Note that you had no obligation to allow access to install a new bathroom (unless the new installation was necessary due to disrepair).

          Hi thanks for your replies. LL was there everyday with his uncle helping out. According to LL his uncle is a qualified bathroom fitter. There was no real reason for a new bathroom other one was just a bit old but ok. We called the LL when got back to say we were unhappy and all he said was he cut back the garden which wasn't his responsibilty so had saved us work there. We never asked him to cut back the garden and I really don't think it justifies the condition the place was left in! He basically thought we were unreasonable complaining and we were so angry we decided not to carry on the conversation. We have taken photos of mess and damage to show if necessary but plan to write to him with all our complaints and to ask for compensation but not sure how to quantify it. Do you think this is the right approach at this stage? Thanks.

            Yup, and make it a calm, polite but direct letter. Recognise if he was only trying to upgrade Bathroom to get higher rent he migh just decide to give you Notice2quit...
