    Help please. Tenant just checked out with so called inventory checker. House according to them clean tidy and ready to let again. My view very dirty; carpets stained, walls badly marked, oven filthy. In addition, Broadband installed without permission (holes now left in walls where it has been torn out). Children's border trim put up in two bedrooms necessitating redecorating as cannot be removed without damage, child locks on all kitchen cupboards which leave holes when removed, curtains and rails removed; curtains put in loft so now need dry cleaning. Cupboard hung in bathroom again leaving again holes which cannot be filled without redecor. Patio door step snapped off. Deposit will not cover work needed. Agent seems to be more tenant orientated than landlord orientated, despite fact we have been paying management fee to them each month. If make good repairs come to more than deposit what can I do? Help please - don't want to be unreasonable but this seems more than just fair wear and tear.

    First thing to bear in mind is that even if repairs are less than the deposit, that dosen't mean the tenant will agree to the deductions - especially if the inventory clerk has given everything a clean bill of health.

    I think that the tenant has a right to expect no deductions if YOUR agent has said the property is okay. So I think your first action should be to get the agency to view the property again with you so that you can point out he discrepancies, and discuss how they intend to resolve the issue.

      Then when it is finally resolved, sack the agent. He is probably hand-in-glove with the supposedly independent inventory clerk.

        Tenant in for 2 years. Wear and tear expected but all blinds trashed etc. Will await full report from inventory clerk and take your advice and return with agent. Surely the conditions in AST re carpet cleaning on checkout etc should be obeyed? Garden also a jungle while AST states should be well kept and well pruned. Wish I could name and shame the agent!

          Instruct your own independent inventory clerk and pronto.

          When have report in hand, get agent to come to the property and take both reports with you (don't tell agent that you have your own inventory report).
          See what they have to say, if they turn up.

            a) so the mobile home does not provide the (very) basic facilities that any tenant or judge would expect for a dwelling....
            b) Agree with jpk: Should it get to court (which is when the issue matters..) can;t see any judge deciding it's anything but a tenancy & you the landlord er... not at...

            It's almost impossible to reset the tenancy with a new agreement.
            The buyer will inherit the previous tenancy at the same point that they're able to let the property on the new agreement, so any new tenancy is going to be a follow on tenancy.
            So things that need to be done at the very start...

            You're really going to struggle with that not being a tenancy.
            If the tenant can lock the door to exclude you, and they could wash in a sink, that's likely to be a dwelling house.

            From your other thread you are seeing a broker about a BTL mortgage. I think you will struggle to secure a BTL mortgage against a property with a Regulated Tenancy in place....
