    expiry date on s21 and court action

    I have looked through previous threads but could not find the answer to this particular question. I have issued a S21(4)(a) with a date of expiry of 22nd September. Do I have to wait until after that date to start the process on www.possessionclaim.gov.uk or can I start now to quicken the process up.

    So what do you expect to do about your claim and money for court costs if they leave?
    Allow tenants to protect their own deposits. I want free money when they do it wrong

      You can't use the above site for s21 claims, only for s8 breach of tenancy.

      s21 can be horrendous, and it is easy to get simple things wrong and get the case thrown out.

      If you give the start and end dates of the first TA, and the expiry of any current, the date you issued the s21 and how it was served, you will find out sooner rather than later if you have done it correctly.
      On some things I am very knowledgeable, on other things I am stupid. Trouble is, sometimes I discover that the former is the latter or vice versa, and I don't know this until later - maybe even much later. Because of the number of posts I have done, I am now a Senior Member. However, read anything I write with the above in mind.

        Thanks for your replies. I have been informed that the tenant (on housing benefit with one child) in order to be classed as homeless and i assume will be entitled to local authority housing after the court action will not move out by the 22nd sept. Hence the question. I know she will not move out, so can I start proceedings before the expiry date.?
        Regarding dates, I am sure the dates are correct because I asked that question on another thread some time ago and Jeffrey kindly put me right

          You can commence proceedings when you like but you can't have a court hearing until after your S.21 Notice has expired. Check with the court as to how long the APP is taking at the moment.
