    Wanting possession as I need to move back there!

    Help!!

    I have sold my house and need to move back to my rented property (not my preferred choice but I have no other option unfortuantely.

    I notice on the section 8 form there is nowhere to put this, and I assume I can have my property back for me to live in. Incidentally I know prior notice should be given but the rental agreement started 1/6/06 and I have only had my house up for sale for about 1 month and I didn't think it would need so quick.

    Your post isn't very clear, but here goes
    1. If you have "sold" your house you currently live in (you don't say) then it will be a while before completion takes place - yes? Of course it might fall through as well!
    2. If you have a tenant who moved in to another investment property you own? (you don't say) on 1 June 2006 then the earliest you can regain possession will be after 30 November 2006 if the fixed term was 6 months or fewer. Of course it could be a property you rented yourself as tenant and still have a tenancy agreement but such is the poor quality of your post who the hell knows?
    3. A S.8 Notice is only relevant to rent arrears; what you need to serve is a S.21(1)(b) Notice, and you can do it now but make sure you complete it correctly if your tenancy is for 6 months, and it can't expire before 30 November.

      If you used to live in the property, before the tenants took up occupation did you issue the correct prior legal notice that you may seek possession on this ground?

          Well last time she didn't mention anything about wanting to move in to the rented house herself, which presumably she thinks might change things. But it does bug me when people post the same thing under different guises or scenarios - why not just append the new info to the original thread?
