    I AM INHERITING A FLAT WITH A TENANT WHO DOES NOT HAVE ANY AGREEMENT & NO BOND WAS TAKEN AND IS ALWAYS 5 WEEKS RENT IN AREARS. HE HAS BEEN IN THE PROPERTY FOR ABOUT
    3 YEARS. i AM HAPPY TO KEEP HIM ON IF HE CLEARS THE ARREARS BUT I WANT A CONTRACT TO START AND TAKE A BOND.CAN I DO THIS

    First off, please do not use caps-lock. It comes across as shouting.

    You cannot force the tenant to sign a new contract. There is already an existing contract, whether written or verbal. You also cannot force the tenant to pay a deposit after three years.

    It would be highly advisable to seek specialist advice from a landlord & tenant solicitor as to your legal obligations as landlord, before considering the demands you would like to impose on the tenant.

      So what is the current ownership status of the flat? Where is the Probate process??

      I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...
