    T on conditional bail, not to return- effect on tenancy?

    I'm just waiting for the courts to grant me a possession order to evict my tenant from my flat (have gone down the s21/accelerated possession route and at final stages - his tenancy was up at end of March and he hasn't paid rent since January). I was told today that my file is with the judge and i will know outcome tomorrow.

    Last week after an incident between my tenant and i, he was arrested and charged with racial abuse, threating with a bladed weapon and affray. He was bailed to his brother's address and bail was conditional that he does not live or sleep in my property and he does not contact me except through solicitors regarding his property. The trial will be at the end of September. I haven't heard from him since.

    Once i receive the possession order what are my next steps? I've requested immediate possession as there is no point in giving him 14 days to get out because he's not allowed in!

    Once the possession order is 'valid' (so immediate or after period of time set by the courts) what am i legally able to do? What are my next steps?

    - Can i change the locks? (he changed them when i gave him notice so i don't have a key)
    - Can i enter the property?
    - If his stuff is still in there can i contact him and tell him to arrange collection?
    - If he doesn't collect then what do i do with his stuff?
    - Do i have to get a warrant of possession and get bailiffs round even though legally he isn't supposed to be there anyway?

    Desperate for any help here.

    Just received my possession order giving my tenant two weeks to vacate the property.

    I'm desperately trying to ascertain what i can do next? Its doubtful he will be collecting his post so he won't see the possession order and he isn't allowed to contact me so can't tell me if he's moved out or not (which i doubt he would do anyway).

    Is there any way round waiting 14 days as per the possession order and then instructing the bailiffs to get someone out who isn't allowed in there anyway?

    Really confused and would be so grateful for any help.

      Since you already have the PO be patient and wait for the bailiff to empty the place for you. Take a locksmith with you to change the locks. His possessions need to be put into storage and let the court advise him where they are.

        but i have to wait for the 14 days posession order before i instruct bailiffs and there is a 5 week waiting list for this?

        Also what is the bailiff process. Do they give me a date and a time and i go round with a locksmith?

          Sorry, I misunderstood, I thought you already had the bailiffs booked.

          It would still not be a good idea to take the property back until you have had the bailiff give you possession. The tenant could claim unlawful eviction and quite possibly win.

          You could try calling the bailiff office on a daily basis and see if they have a slot free, they'll soon get fed up with you and do the job. But first you have to book them of course.

            They sound like sharks and scammers, i would push it and fight them, my guess is they will back down. I agree that i would not wish to be linked to these cowboys. Good luck.

            Even if you are an AST "tenant", you are tenant of Sarah, not a tenant of Sarah's landlord. If Sarah ceases to be a tenant that does not make you a tenant of Sarah's landlord (nor does any deposit you paid to Sarah have anything to do with Sarah's landlord).

            Did you use them on a tenant find service only ? If so then read the contract you signed and see what it says about what you are about to do, i use the tenant find service but then let the leases go into periodic, i pay the agent nothing and never have done, maybe if i signed another 12 AST a fee may...

            There's not normally an issue with the gas certificate timing other than the very first one.
            That said email is not how you give people documents like that, unless the tenant has agreed to be served them by email.
