I'm just waiting for the courts to grant me a possession order to evict my tenant from my flat (have gone down the s21/accelerated possession route and at final stages - his tenancy was up at end of March and he hasn't paid rent since January). I was told today that my file is with the judge and i will know outcome tomorrow.
Last week after an incident between my tenant and i, he was arrested and charged with racial abuse, threating with a bladed weapon and affray. He was bailed to his brother's address and bail was conditional that he does not live or sleep in my property and he does not contact me except through solicitors regarding his property. The trial will be at the end of September. I haven't heard from him since.
Once i receive the possession order what are my next steps? I've requested immediate possession as there is no point in giving him 14 days to get out because he's not allowed in!
Once the possession order is 'valid' (so immediate or after period of time set by the courts) what am i legally able to do? What are my next steps?
- Can i change the locks? (he changed them when i gave him notice so i don't have a key)
- Can i enter the property?
- If his stuff is still in there can i contact him and tell him to arrange collection?
- If he doesn't collect then what do i do with his stuff?
- Do i have to get a warrant of possession and get bailiffs round even though legally he isn't supposed to be there anyway?
