    Eviction issues

    I have obtained a possession order and am expecting to have to instruct bailiffs to remove my tenant as they are unlikely to vacate the property when required.

    I have 3 questions:

    1) In the absence of an independent inventory check out commissioned by the tenant, what happens about issues such as meter readings and agreeing damage to the property? I am concerned that if I make a claim against the tenant for the repairs to the property the fact that there is no independent inventory check out will count against me.

    2) Is the small claims process the best way to recover unpaid rent and repairs of less than Ā£1,000 in total after the security deposit? (Originally I served a section 21, i.e. possession is NOT on the grounds of non payment of rent).

    3) Anything else I should consider? After many years of letting this is my first eviction

    sorry to be the bearer of bad tidings but your chances of collecting are very roughly nil!

    if u have the tenants NI number this is a start to tracing them but dont hold your breath.

      The tenant has a business locally and I know where they are going to be living. Any other advice?

        thats great

        sue em for the rent dont worry about the damages, better to sue for what cannot be denied as being due. If you do get that money it will be a result

          You could simply say to them that from XXXX date the property will not be let as is has been sold....... that is all you say, no mention of the buyers being the in-situ tenants.

          It was fully managed.

          yes I do plan to speak to agent. My concern is they will try and use it as leverage to insert themselves in the sale process. Just wondered if anyone else has hit anything similar?

          Speak to your agent & ask them to put in writing what fees would be charged in the event of this happening....

          The original arrangement with the tenants, was it ia fully managed or tenant find only arrangement ? I have done this a few times on a tenant find basis and let all my AST's go periodic (so the tenants stay), i have paid zero to every agent, and they have never been knocking asking for any money.

          With regards to keep or sell. Those 4 properties are not just assets, but you need to see them as say children, which need looking after. You can't switch off because you are busy. It is 24/7 responsibility, as you are responsible for the property and the health and safety of the people living. If...

          Almost anything beats working for a living.

          Running a portfolio is just as demanding and stressful. If someone worked in an office, it is a 9 to 5 job. Their taxes are paid by their employer.


          Running a portfolio of properties, can be demanding. Even with agents in place....

          Becoming a landlord because you've inherited some property makes about as much sense as inheriting several cars and setting up a taxi business.
