    partial deposit/ DPS

    Hello,

    I have a question if the T did not pay the deposit in full and stopeed paying rent straight after the move in date. Should I or should I not protect the part of the deposit received?

    It has been 4 months and no rent payments and/or remaining deposit received. i want to serve s8 and therefore am not sure what the stance needs to be with the deposit in such case.

    P.S. i trist many of you will say I am stupid to allow this and i am quite aware of it, but would appreaciate advice a lot.

    hmmn..something I would like to know too about the DPS.

      Yes. Protect whatever part of the deposit you have asap. You can issue a S8 g's 8/10/11 now. If the money owed is not reduced below two months then you can start court proceedings after two weeks.

      Godfather, we have already explained to you that the rent is two months owing if the T does not pay on two successive rent due dates, that can be as little as one month and one day. The waiting period for starting proceedings is two weeks after that. Do not alter the form at all, the phrases in it are there by statute. Just fill in the relevant bits. use the full wording of each ground when you fill it in.

      Money owed can also accrue in dribs and drabs so keep a close eye on what comes in and from where.

        There was a case in Bristol similar where the judge rule that the landlord was right to give the original tenant the pi only and didn't need to for a later tenant but I know there was other info about the case, worth no win no fee tho
