    Tenant won't move in !

    I have a tenant who rarely occupies the house rented to her under an AST agreement.She just comes round to collect her post.I am getting rent but this is unsatisfactory as I do not want the house to be void for months as I don't think it is very secure and this may invalidate the insurance.Is there anything I can do about this given that she stays there no more than one night every couple of weeks?Any advice would be welcome!

    Most house insurances would only void if the property were empty for 30 days or more but check the wording of your policy. Is the house void for months or only for a couple of weeks at a time, your post seems a little contradictory

    As far as collecting rent and having minimal occupation wear and tear I'd think a lot of landlords would want to swap places with you.
    My advice is not based on formal legal training but experience gained in 20+ years in the letting industry.

      I think there are other issues here that are relevant, for instance:-
      1. The tenant has a duty of care to look after the property at all times.
      2. They must behave in a tenant-like manner.
      3. The tenant may indeed be compromising the landlord's insurance conditions.
      4. To be a valid AST it has to be the occupants principal or main residence.


      I would be inclined to write to the tenant and state that unless they occupy the property as their main residence you might seek possession under Grounds 12 & 13 of S.8 under the Housing Act 1996.
