    Rent increase by s.13 of Housing Act 1988

    I served a s13 notice on a T on 28th April for a rent increase of £50 effective from 6th June. The Tenant rang to say he couldnt afford the rent and would be giving notice.

    I recieved his notice on 4th June terminating his tenancy on 5th July stating the reason he was leaving was because he couldnt afford the extra £50 a month. The small company I work for say we are entitled to the new rent from 6th June but I'm not sure as he hasnt agreed to it. The T paid the rent at the old price on the 6th June. Please can someone let me know if we can charge for the new rent even if the T hasnt agreed to the increase.

    I have worked in lettings for many years but at my previosu company we didnt use S13 we just drew up a new contract once the T had agreed to the increase.
