landlord resp for replacing carpets

Can anyone please advise if the landlord is responsible for replacing carpets at the request of the tenant mid-way through a 12 month AST or would this normally be the tenant's responsibility?

Why does the tenant want the carpets replaced during the tenancy? Were they in bad condition at the beginning or are they just not to their taste.

If the tenant were to replace the carpets during the tenancy, you would have to make arrangements to store the original carpets until the end of the tenancy and decide who pays for the removal, storage and refitting, it would reasonably be the tenant who bears those costs, unless the carpet is unusable and will be thrown out. If the tenant replaces the carpets at their own expense, they would usually continue to be owned by the tenant after the tenancy had ended (unless they gave them to you).

It all depends on the condition of the carpet concerned and why it is now in a state that the tenant deems that replacement is necessary. I mean if it was almost worn out when the tenancy started, what was said when the tenant viewed initially? Carpets don't wear out that quickly and I am suprised that it needs replacing so quickly - unless its state is the result of the tenant's treatment of it, in which replacement is the tenant's responsibility.
Last year one of my tenants complained about the state of her landing carpet. This carpet had been down for a good few years and I knew the tenant was not one of those who would abuse a carpet. I thus authorised a replacement at my expense without question. She even got to choose the colour!

Unless the carpet is falling apart (is it?), then it should not need replacing. If it does, then the LL would normally do this (and pay).

If it has been damaged/ruined by the tenant, then T pays (full cost of replacement minus an allowance for the wear and tear it would have suffered anyway - usually 10% of value per year, so 5% for 6 months).

If however T has just decided they don't like the carpet, tough! They knew that's what it was like at the start of the tenancy; they cannot suddenly go off it and expect a replacement.

a) Who owns the carpet ?
b) Does the AST state the carpet is the sole responsibilty of the tenant to maintain, upkeep, and replace when worn ?

If Landlords let, with a carpet included, the carpet belongs to Landlord, and should last 5 years, and when it gets worn, / time to replace, the landlord replaces it out of the profit he has made in the last 5 years.

a tenant can request anything to be seen to, if it is starting to wear. Up to landlord to decide when to replace.

The carpet is a little worn, but its not too bad. The tenant has a nine month old baby who has just started crawling so they've requested a change of carpet.

The rent is always paid on time and its a tenant I'd like to retain, so I may just replace the carpet this time round.

I just wanted to know where I stood on the matter. Thanks again.

If the carpets were steam cleaned would it improve them? I'd be reluctant to put new carpets in a house where there are young children, even in my own home!

The carpets were steam cleaned befor the tenant moved in. I'll have to pop round there to take a look for myself.

Me too. I would lay sealed cement - or at least that washable flooring you get in hospitals - over the whole of the ground floor and avoid carpets until they were at least 21 years of age, in fact.

landlord not willing to change carpet

hi, i need help regarding this issue i moved in this property august 2008, its a three bed house, after almost now 4 yrs we requested landlord to change carpet he refused. as when we moved in only one room carpet was new an rest old. do i have any right to force him to do so, as he is from those group of people who wont spend a penny. dont know wat to do as its suffocating an causing breathing problem. plz anyone guide me to sort out.

Wafa, if you have lived there three years, and the carpet is now causing breathing problems, doesn't that suggest that it is dusty, and needs steam cleaning?

The landlord has no obligation to replace carpets unless they are causing a danger. In what way is the carpet suffocating you? The carpet in my own lounge is at least 15 years old (and no, it isn't posh stuff).

yea we did it an it cost me £250 still its same coz top wool part is flat an carpet is without underlay. an i think its 7-8yrs old. coz i regulary do hover twice a week. wat else can i do?

As the previous poster asked - how is this carpet suffocating you?

Not being awkward - but nobody can offer realistic advice if you don't explain clearly what your problem is.
