    Agreements to pay back rent arrears

    I am about to receive the keys back from one of my tenants as he has given up possession after going into rent arrears to a rather substantial amount of money. £1100 to be precise.

    He has suggested that he pays back about £100 a month. Should I put this agreement into writing and have him sign this? Would that be the best option.

    He can't afford anymore than that so this is the only option really.

    make sure you draft a surrender of tenancy for T to sign so you have proof that he surrendered the tenancy voluntarily.you can include the arrangement to pay back the rent arrears as well as it would be good to have it in writing and for him to sign.

      This may just be an attempt to get you off his back.

      To be ultra-sure, get a judgement against him for £100 per month now. Then if he defaults, you can go in guns blazing without having the delay of a court claim.

        I agree, sometimes you have to take a sensible approach. However, DO BE CAREFUL. I had a guy last year who owed £900, I let him pay it back in 3 installments, but he failed to pay the last one, Therefore still owing me £200. I cannot be bothered with small claims court for this amount, but I wish I had been more careful.
        I'd suggest you try get someone to guarantee his repayment plan. If he has problems getting someone to agree, this would make me suspicious, If family and friends don't trust him, why should you!?!

          Surely the handing over of the keys is indication that the tenancy as been surrendered? No?

            Not always. Better use a formal Deed of Surrender.
