    Assured Shorthold Tenancy (fixed term)

    Phew! On the last leg of my first "letting". Have got a AST all drawn up and am pondering over whether to put a date in for the Agreement to end. We did mention (verbally) that the tenancy would be for 6 months initially.

    However, the notes which accompany this Agreement say "Please note you do not need to complete this section, and you may delete it. If no date is inserted, the tenancy will simply continue indefinitely as indicated by the following para of the agreement."

    The para. mentioned reads " OR the tenancy shall terminate upon either party serving upon the other the required statutory notice. If there is no fixed period specified, the tenancy shall be a periodid tenancy governed by the frequency of the rent payments as stipulated above."

    What should I do? What would be best?

    Never state an end date. Always state only the start date ("On and from xxx") and term.
    Delete the 'end date' section which the side-note mentions.

      Going by the above, I think the best thing you can do is to study the agreement carefully with the benefit of the notes. When you have done that, set fire to both and scatter the ashes to the wind so that all trace is lost to the benefit of mankind.

          Sounds like some education in how to be a landlord might be wise. When I started I thought I knew what I was doing. I didn't, expensive, stupid, mistakes! If you think education is expensive, try ignorance....

          Agreed, break clauses very very easy to get wrong.

          Much simpler, easier, more flexibility to evict, fixed term 6 months then periodic....

          Well you have heard the opinions of a great many very experienced landlords........ you are taking a very big risk with this, you say you don't need the money, so why take the risk ? Leave it empty and come back to it still....... empty, there is zero guarantee they will move out, friends or not.

          You created the AST, or you got it from somewhere?

          You can get the AST signed before someone moves in (how soon would they actually move in?) and when are you giving the keys?

          You should have a Guarantor's specific agreement if your going down that route, these days they can...

          Generally yes, landlord only break clause is an unfair term. There's really only very limited reasons to have break clause in typical residential letting. Just do a 6 months fixed term and then let it roll periodic.

          If the landlord does this then the storage company would come after him as it's he who has the contract witht them, not sure i would do this. I would though ask the Police to pass on the ex lodgers legal representitive, he or she will be in contact with the alleged offender and they can ask him what...
