    Hiya

    Thanks for your comments. This has now been made clear. Thanks also Westminster. I did read your comments and appreciate your answers, however I was confused because my rent is paid by the Council so I wasn't sure which dates would apply, the dates the Council pay me or as per the tenancy Agreement. The Council have clarified that it would go by the Tenancy Agreement.

      No, the rent is not paid 'by the Council'.
      The rent is paid by your T. It might be from funds (HB/LHA) sourced from the Council or T might pay part/all in person.

        Rental periods in a statutory periodic tenancy are calculated according to the frequency of rent payments under the terms of the contract (e.g. monthly, weekly), and the date the last fixed term contract ended.

        So, if rent is due every calendar month, the rental periods are a calendar month long. And these month long periods begin on the day after the last fixed term contract ended.

        This is all regardless of the date rent falls due, or the date you actually receive rental payments, whether direct from T or via the council - these are incidental facts which have no bearing on the rental periods.

          For your sake I hope it is just the tenant playing games because the next tenant will complain too if it’s anything like penetrating damp, poor state of the structure of the walls roof tiles missing etx.

          The tenant should get a report done by a surveyor to prove it really as hard evidence...

          Unless your tenancy agreement creates a contractual periodic tenancy, if you're in England a periodic tenancy is created by the Housing Act 1988.

          If the How to Rent booklet has changed since you gave the tenant a copy originally, you should give them the version that was current when the...

          if your agreement said it would become periodic then it is a Contractual Periodic Tenancy; if your tenancy said nothing it will become a statutory periodic tenancy.

          My understanding is the first is a continuation of the original & the second is a 'new' tenancy. A new tenancy needs all...

          If you allow the T to change the locks, make sure they meet your insurance policy requirements, once the T leaves they can replace it with the originals or your get new locks. Get a copy of any keys you will require for access.
