    Can anyone recommend a solicitor in Taunton Somerset for serving a Section 8 & 21?

    We have a tenant who is not paying rent at the minute- second month is due tomorrow. We believe that he now has no real intention of paying and so want to serve a section 8 as soon as the 2nd month is due. Can anyone please advise on a solicitor in Taunton to carry this out as we need it done quickly as we cannot sustain unpaid rent.

    You can get a free template for the s8 notice off this site (click on Agreements & re-register) and you can commence the court proceedings online at www.possessionclaim.gov.uk for £100 (or £150 if you do it on forms by mail)

      We had heard that it was best to get a solicitor - that if you did it yourself and had made any mistakes on the form then a court would dismiss it. Do you know if this is true?

        It is true that it must be validly completed and served but it is not complicated. Download the forms and you'll see what I mean.

        If you tell us the date the tenancy started, whether it is still within the fixed term or has become a statutory periodic, and on what day the rent falls due (presumably monthly), we can help you with the correct dates to put on the s21.

          If you do decide to use the services of a solicitor, then you are strongly advised to find one who is well versed in landlord/tenant law as not all are and as such some can just as easily make the same mistakes as us amateurs. You are thus recommended to approach either one of the board topic experts who indicate that they are prepared to assist private clients or one of our advertisers. They all DO know what they are doing in this field of law.

            My understanding is that L is only responsible for an infestation present at the start of the tenancy, after that it's Ts responsibility. My council will send pest control for rats for free. They don't all but it would be worth asking. I would see what else is available for rent. Given his attitude...

            I thought about that but I don't see the tenants doing that. We'll all get on the wrong side of the LL if we force him to provide an address he didn't want to provide in the first place and he may well use the agent's address....

            You say he increased rent by 25% and that was within his rights. He only has the right to propose an increase (you have the right to propose a lower increase or indeed a decrease). You had the right to appeal the increase: Did you?
