My tenants are the Letting Agents!

Hello there. New to this forum so be gentle with me!

I have a colleague who has a property that is rented to Northwood in Swindon who then sub let it to tenants. Today, it has transpired that Northwood are no longer trading in Swindon, the directors are setting up another rentals business in Swindon under a different name.

My colleague has been chasing them up for missed rental payments and they keep fobbing her off with excuses. They have not paid her for this month and despite promising her they would make the payments they have not arrived.

What is the best course of action for her to take on the management of the property herself? Now that Northwood are no longer trading, is her contract with them void? By virtue of the fact they have not paid her, surely they have broken the contract in any case?

Would anyone recommend she goes to their new offices and remove goods to the value of the debt and if they call the police, it will be seen as a civil matter?

I don't have an answer for your other questions, but I can tell you that your friend is not entitled to go to someone's office and steal property. She will get arrested for theft.

I would do nothing on the paperwork side, as you have nothing to gain (since she does not officially work), up the rent to compensate for the additional wear and tear.

But that's not the answer though. There's nothing stopping the scheme from continuing to provide valid protection on replacement tenancies. In practice, custodial schemes does that but insurance schemes doesn't.... EXCEPT they do for statutory periodic tenancies that arise after a fixed term so long...

I was a bit surprised by this, myself, and that these people agree to go into temporary accommodation, but this has only recently surfaced. DW won't give a finish date but are very keen to sell. I thought I can help out the current owner, but by the looks of things, I cannot do this....

Hi, I have exchanged contracts on a house which I will buy with a buy-to-let mortgage.
The current owner has bought a new house of David Wilson's homes and they have taken his old house in exchange, which I now bought via them.

This sounds dodgy, he clearly is aware of what you can do if he goes out for the day, i think you will need to consider a forceful removal..... but that is an area i am unfamilar with (from a civil point of view anyway).
