    contract break question

    Hello
    My situation is as follow:
    i have a 1 year contract with a landlord with break clause agreement from month 6. I'm in the second month but want to break it right now. I paid 1 month deposit.

    I understood, when i signed the contract, that only my deposit was engaged if i didn't respect the clauses. Now the landlord tells me that i have to pay the whole 6 months, i can't withdraw, which is something i was not aware.

    Is it really something legal? i come from france where a such contract couldn't be possible (i mean, if a tenant want to leave without respecting the notice period, the renter keep the deposit and that's all).

    What happens if i give back the keys now, can they sue me?
    Have you got any advice?

    You signed for twelve months. You knew that the only break-right was at six months. Why should you not be compelled to do what you agreed to do?

        Oo La La! - Thats the limit of my French, and I suspect that is spelled incorrectly (like much of my English)

          I hate to rain on your parade, as they say, but I can honestly say I have never once heard a French person say 'Ooh, la la'! They may do, I suppose. I think it may be akin to the way some French people think all English men walk around in bowler hats. And that is nothing compared to some of the bizarre and unhelpful stereotypes my pupils cherish of the French...

            His version omitted the h. That explains why you've never heard the 'ooh', only the 'oo'.

                because of unexpected facts of course (i had 1 day only to find accomodation and i'm finaly too far from my new job). I thought i would stay but I would never have signed if i had understood that whatever happens i would have to pay the 6 months.

                  I understand; but the landlord cannot be compelled to take account of your personal circumstances.

                      I understand, but I'm sorry, a contract is legally binding. Your landlord must let you have the accommodation for the entire six months and you must pay the rent for the entire 6 months.

                      You could ask him to let you go earlier if you find a replacement tenant (try accommodationforstudents - lots of students and young profesisonal workers look on it to find a room/flat).

                          I rent a 2 bedroom house. I have a relaxed landlord that does the minimum but she's kind and mostly fair. I'm very good friends with her granddaughter. Sometimes the line is blurry with tenant-landlord communication...

                          If you found the frames, arranged collection and paid the costs of collection I would suggest they are yours. If your friend is going to insist on them staying at the cost of your friendship she isn't much of a friend.

                          I would take everything with me except what was on the inventory when...

                          Thank you for the info. The house she rented from me a few years ago is and was solely in my name, I used to live there as a teenager and it's just around the corner from her mum. All of the money she paid went to her mum to be repaid to her for a deposit on a house.

                          I wonder if I could get some advice on ending an AST tenancy in England.

                          Originally a 6 month AST last Sept between my niece and her partner, I foolishly listed both on the AST as joint tenants and didn't list him as a permitted, there was no deposit paid....

                          royw - Well said, if only, we have far too many 'hangers-on' and those with a vested interest in doing the very least for the very most.

                          Any scheme introduced which will be administered by the local authorities will be an exercise in futility, they will take our money and pocket it, simply...

                          Sadly, the more and more time I spend on this forum, the more I'm coming round to the idea.

                          NRLA training is straight-forward and very cheap, people should take a look. There is the added benefit of all the advice and forms etc...

                          They should start by making sure letting agents know what they're doing.
                          No register will be free, we will be paying the inflated salaries of yet more pen pushers. The law abiding will pay for it and the rogue landlords will continue to ignore regulations just as they do now. IMO the country...

                          We also need tenants to educate themselves - the How to Rent guide is so basic and by the time they receive it it is too late. Tenants calling out LLs on EPCs, gas safety, EICRs would encourage LLs to be compliant and we could identify tenants who are complicit in poor standards in return for cheap...
