    If I am not taking a deposit, just asking for the rent to be 1 month in advance, will the tenancy still be an AST?

    A deposit is not a legal necessity.
    Even if L receives a deposit that should be protected but fails to protect it, the AST letting remains an AST [but without s.21 powers].
