    'iyc' charity - lends deposits - LL wanting advice

    Our good tenant is moving out on the 18th August after having given notice, and his sister (who is already living there unknown to us) is going to be our new tenant.

    However, things haven't got off to a good start as she has only just given us the deposit and is now saying that she can't affort the 2 months rental in advance on the day the tenancy agreement starts ie the 18th August.
    She has now contacted a charity group called 'Its Your Choice' http://www.iyc.org.uk/housing/page3.html
    they say they will pay her deposit for her and she then has to pay them back monthly.
    HAS ANYBODY ELSE HAD ANY DEALINGS WITH THIS GROUP??
    We are concerned that , at the end of the tenancy, if any damage has been done and we want to keep some of the deposit, they may be biased in her favour seeing as the charity is all about helping young people.
    ALSO - IF WE DECIDE WE WANT HER OUT NOW - SEEING AS SHE HAS'NT EVER PAID US RENT - SHE IS NOT A SITTING TENANT - SO WHAT IS SHE?? SQUATTER??

    She is your tenant's lodger (excluded occupier), I think. Therefore, he can evict her easily.

    Personally, I'd tell the tenant to get her out NOW, before he moves out (and pay back her deposit). It sounds very much like she can't afford the rent. She's been living there, paying probably much less than half the rent, and hasn't saved enough to pay two months up front...? If you do go ahead with her as a tenant, get proper references and demand a guarantor. And don't forget inventory check-in and deposit protection.

    They don't look like they are awash with cash...

    In your shoes I'd be cautious...

    - (apologies in advance for judgemental remark) but that sounds like their clients may be more likely than not to have had an "interesting" history. Clearly these clients have every right to a decent home and fair and considered treatment, like the rest of us.

    Think I'd 'phone them up & ask the very general, in principle, questions, without naming names, of how long the deposit bond scheme has been working and are there any Landlords you could talk to who have had a happy experience of it - after the tenancy has ended....

    Actually the charity group states "Instead of a cash deposit, we offer landlords a deposit bond - effectively guaranteeing to pay up to the value of the deposit to the landlord should it become necessary after an applicant has left the accommodation." which is not the same thing...

    (Never heard of the outfit but in your shoes I would be equally cautious).

    The sub-paragraph in question only applies after the end of "fixed tenancy", but explicitly includes the possibility of an SPT, or other periodic continuation....

    Tell the landlord that if he repays you the deposit in full from his own funds, you will agree to him retaining the full deposit that's in the DPS account. It shouldn't be beyond his means to front fund this for 30 days....

    It was mentioned, but the main debate in that thread is whether the use of some kind of granny flat would be a lodger or a tenancy arrangement.
    So mostly about people living there.

    Creating a situation where people stay somewhere temporarily is a different thing (it seems to me)....

    I don't think the indefinite contract things going to fly.
    This is a straightforward lease with an initial term that continues in some (oddly undefined) way.

    The only unusual thing about it is that the terms of the continuation aren't defined, which they normally would be - so there...
