    Deposit - breach of original lease

    Paid deposit in February 2009 in relation to AST with four others. Deposit was protected in TDS.

    Supposed to move in to house August 2008. Agents could not get house ready for some time so one tenant decided not to move in. Lease was ripped up and a new one created some 2-3 weeks later with two different tenants.

    Agents are now making all kinds of unfounded claims about arrears. When we paid the deposit in February 2008 this was in relation to the original lease. As the lease was broken can we claim the deposit back mid-way through new tenancy as the orginal deposit did not relate to this new agreement signed three weeks later.
