  • Landlord Name on S48 notice

    In my tenancy agreements, i always include my name and address to comply with S48 (I forget exactly which act - LTA 1987?). It is the only place I use my own name rather than my trading as name. Eg all my documentation refers to "Rachmann Estates" (no not really my trading name), but my S48 notice reads;

    Mr Robin B'stard T/A Rachmann Estates

    Do I need to have the my name T/A bit there or can I just refer to Rachmann Estates?

    The S.48 is a requirement just for an address in England & Wales to be given where the tenant might serve Notices on the landlord, but if the landlord's name or address is not shown the tenant could then make a written request under S.1 L&T Act 1985 and it must be complied with within 21 days otherwise it's a criminal offence not to do so. Remember also for £3 a tenant can make a search of the Land Registry to find the identity of the registered owner.

      "There is no requirement for sole traders to register a business name. They can trade under their own names or choose a different business name. However, if as a sole trader you choose something other than your own name for the business, you must include your own name and the business address on all business letters, orders and receipts"

      I would think this includes a rental agreement.

            On some things I am very knowledgeable, on other things I am stupid. Trouble is, sometimes I discover that the former is the latter or vice versa, and I don't know this until later - maybe even much later. Because of the number of posts I have done, I am now a Senior Member. However, read anything I write with the above in mind.
