    Deposit Single Claim

    I have put in a single claim for the deposit. On the declaration I based my argument against the fact that T didn't pay a month rent. There are other arrears but the deposit doesn't cover all of it. I don't have the forwarding address. T is refusing the claim and ADR will come into effect. When sending evidence should I include all the arrears or just concentrate on the one month rent?

    Send everything so that if you decide to go to court later there are copies on record.
    If the amount owed is more than the deposit & you want it all back go straight to court (if it's worth it obv)
    Sending it all should also guarantee you get the full deposit (if this was more than the rent)
    Also send in copies of your bank income statements or a speadsheet rent schedule stating date of commencement and each subsequent rent date and payment and dates T fell into arrears and how many days late it is.
    Basically cover yourself.

      Thanks I will send everything. But can't I also say that I don't want to use the ADR service (What happens if one party does not agree to use the ADR service? - https://www.depositprotection.com/Pu...ction=ADR#Q5)?

      My claim is higher than the deposit itself. Can't I ask them to provide the tenants address? Or if I do use ADR won't they have to give me his address?

        I have issued multiple CCJs. Three of them are still unpaid.

        I have also issued Third Party Debt Order which was successful.

        But the ex T. still owes me money and more claims are to be issued .

        Thanks to Thatcher's 1988 Housing Act a tenancy continues, monthly periodic, if tenant remains in occupation.

        Unless evicting tenants through court prior you / agent cannot (legally impossible to) prevent this.

        I beg to differ. From experience it was slum landlords not sorting out the property by means of fixing penetrating damp along with missing roof tiles for years.         This is why I think the current letting agents are not very good! All I asked the letting agents was to make sure the tenancy ends on the last day as per the contract and not to extend it....
