  • Overcrowding: maxima for occupation of 1/2/3bed flat?

    hi

    how many people am i legally allowed to house in the following flats:
    1 bed flat
    2 bed flat
    3 bed flat

    i dont want to fall victim to over crowding!

    also, i own a 3 bed flat, can i rent out 3 of the rooms to lodgers and keep the living room to sleep in myself? or do i need some sort of hmo license for this?

    i'd be interested to know the answer to this question below!

    i'm renting a 2 bed to a family

    the couple signed a contract with me with their names on it

    they didnt inform me they had 3 children though....are 5 people legally allowed to stay in my 2 bed flat?

    should i get their childrens names on the contract?

      Have a look at the Housing Acts 1985 and 2004- they contain statutory definitions of 'overcrowding'.

        For statutory overcrowding issues, the lounge is counted as a possible bedroom.

        But as well as statutory overcrowding issues, you will need to look at requirements for houses in multiple occupation, if you are letting to unrelated persons. HMO requirements will require that you provide lounge space to sharers if the rooms are not big enough. The kitchen must be adequate to cope too.

        If you have 3 or more lodgers, your residence becomes an HMO.

        Best talk to your Local Authority regarding licencing and space

          If your flat has a lounge, it is probably OK. If not, it depends how old and what sex the children are.
