    Attachment order against rent deposit

We're obtaining possession against a tenant who's paid zero rent, but did pay a cash deposit, which went into a deposit protection scheme.
I'll be pursuing payment from him.
In the past I've managed to get attachment (garnishee) orders against someone's salary, and I also understand you can make an attachment against someone's bank account.
But does anyone know if a court will make an attachment against a deposit held in a scheme?
    Many thanks.

If your AST states that the deposit can be used by the landlord against rent arrears then send a copy of the document to the scheme to reclaim the tenant's deposit.
The advice I give should not be construed as a definitive answer, and is without prejudice or liability. You are advised to consult a specialist solicitor or other person of equal legal standing.

Also on the prescribed info certificate it does say to state what the deposit will be retained and used for if not returned , so if you have put that it will be used to recover arears this may need to be produced aswell .
