    Living in an office?

    Hi everyone,
    was hoping i could get some info from anyone on here as you know your stuff in this department.
    Have been renting a flat for 4 months, 6 month shorthold lease from estate agents and just found out that the flat i'm living in is possibly classed as an office legally even though they are advertised online as flats and the estate agent is letting them as office or flat.
    Just thought i'd check, if no planning permission has been given to let these as flats as flats instead of 'offices or flats' is my contract void? and could i be evicted? and am i illegally living here without knowing it?
    Can anyone shed any light on the subject? would be much appreciated.

    Are you being charged council tax by the local council? if so they must have it registered as residential.

    If the agent or landlord has included the council tax in the rent then you had better check with the council; you can call them on the pretense of enquiring what the council tax would be for one of the flats at whatever the address is as you're considering moving in.
    My advice is not based on formal legal training but experience gained in 20+ years in the letting industry.

      Don't think this is the case. Valuation Office control whether assessed for Business Rates or Council Tax. All LA do is raise a bill.

      I would think it is the planning department who you would need to check with.

        i pay council tax which i set up when i moved in. the address wasnt even registered with the post office when i moved in, i had to set that up so i could receive mail.
        Two blokes from the council knocked at the door interrogating me about which flats were occupied and which ones werent the other day, wanting to know my details and about my council tax etc.
        They didnt seem to want to speak to the landlord they were quite happy interrogating me.
        This is what got me thinking about why they were here etc and started looking into this,
        A friend on mine checked it out and found permission for the top floor of the building for residential but no mention of any changes to my floor.
        which brings me back to wondering about what exactly i'm living in and if its just an office

            If a business is being run from premises then it is classified under the Use Classes Order i.e. A1 Retail, A2 office etc. which will be determined by the LA.

            The council officials might have just been enquiring whether the premises are being used for residential or business purposes as there could be a "mix" within the building. I don't think it's of great concern.
