    Breach of Verbal Contract??

    We have a flat that we have let for a number of years. We decided when the last tenant left to redcorate and have a new kitchen etc so advertised the flat with a view to taking a new tenant mid-September. 4 weeks ago the second couple to view it agreed to take it from this weekend. They were moving down here to London for his job. They paid a £200 deposit and agreed to sign the 1 year tenancy agreement on the moving in day.

    tonight they have phoned to say that his employer has decided to leave him in Manchester and not move him here so he won't want to take the flat. We feel that we had a verbal contract, backed up by his paying and our accepting of his deposit. He has broken that agreement but do we have any legal redress to ask him to pay the first month's rent as we now have to readvertise. Or are we wasting our time even thinking this?

    It was a holding deposit. You are £200 better off. lucky you. Hope you find a new tenant.
