    Deposit/Rent question?

    Hello,

    I have a tenant leaving on the 21st Sep - Rent was due on the 12th Sep. T cannot pay rent wants it deducted from deposit - I explained dep is dep and rent is rent and you need to pay your rent, he has lrt me know he does not have the cash has used it all up in his new apartment deposit. property looks in good repair, but just wanted to know your views on this?

        You can refuse (I would); he will most likely not pay the last month's rent anyway; and there's nothing you can do about it in practice other than not give him a good reference (which it sounds like he won't need anyway).

        However, at least if you do it that way, then if it turns out later there are damage costs that you wish to deduct from the deposit you can do so, and apply the balance to his rent arrears (providing your tenancy agreement allows for this); then you can chase him for whatever unpaid rent he owes you, through the courts if need be. That's much easier than if you formally allow him to use his deposit for the last month's rent; then if there's any damage which need paying for you'll be having to chase him for that instead - which is much more difficult; less cut-and-dried in court.
