Ending a tenancy

Hi, my partner and I have agreed to sell off our two rental properties and put the capital into our own home and starting up a small business.

My partners tenants moved out this month of their own accord and we have been getting the house ready to go on the market.

As of right now is the section 21 still valid to end a tenancy and how many months notice can I give?

My tenants has been at the property just under two years and I am willing to allow them 5 months notice as I am in no immediate rush per say, but would like the property back before the new regulations come into play in Wales.

Any advice would be helpful.

A S21 notice is a minimum of 2 months notice, and valid for 6 months from serving, remember it does not end a tenancy only a surrender, notice to quit or a court order can end a tenancy.

The best is to communicate with your T's prior to serving any notice, as the situation can turn -ve quickly.

Thank you, yes my aim was to contact my tenant first to let her know my plans for the future of the property and my interest to sell up.

But an S21 is the right way to go once they have been contacted privately by myself?

Yes, as long as all your docs are in order, otherwise you may have issues.

Yes, if you haven't maintained the rent to the market, the T's will find it hard to find another property at the same rent, as well as a supply and demand issue as a number of areas have more T's looking then there are properties available, and therefore may not leave. If you provide the time for the T's to find alternative accommodation, they may not find anything, then you would need to serve notice and wait.

I would serve notice, and keep in touch with the T on how their search is progressing.

S21 has not yet been abolished, but it does not end hhe tensncy and if the tenants dig in, it will take you many months to gain possession.

Thank you for the link Theartfulldodger, yes I am in my right to present an S21. Though browsing on the GOV website it says that LL

"In Wales, you must explain in writing that you are serving an eviction notice under Section 21 of the Housing Act 1998."

Does this mean I simply write my own letter and not bother with a form?

Wales is a bit complicated at the moment, because a new rental regime has been half introduced and it might be worth using a professional service.
