Eviction 2022

Good morning fellow landlords,

After many months waiting for order of possession my tenants has finally received it. I was hoping they would leave on the date given on the possession however to my disappointment they are still there. I will now be applying for a warrant of possession. Does anyone know the time scale of the bailiffs finally evictions my tenants. Based in London.

Background infor- section 21 served in May 2021, applied for a Possession order in December 2021, order for possession May 2022.

You should email the Bailiffs to get an estimated time frame, usually between 6-8 weeks, but get your paperwork sent out asap so there's no additional delays, there will soon be light at the end of the tunnel and you can move on.

Thatcher's 1988 Housing Act s5(1) gives tenants right to stay until bailiffs/hceo, same Act that permits you to serve S21.

I had a wait of 5 weeks for the bailiff appointment recently - outer NW London

I have asked Nottingham court the same question and had an unhelpful reply - “we are unable to answer your question as there are many factors to consider including any backlog the fees section may have and whether any annual leave the bailiff may have booked”.

anyone any idea? If it’s going to be longer than a few weeks, I will ask my solicitor to move to high court.

Baillif wait was approx 4 months from possession notice. Took five minutes for tenants to leave, unsure why appointment time took so long
