Leaving my letting agents after 6 years I will now handle everthing letting .Question with the 5 tenants original contracts all now lapsed and rolling will I need to give them new contracts on leaving the letting Agent who worked on my behalf . My thought is if the tenants are happy with the present rolling contracts they can continue as the letting Agent was working for me and the original contracts that I have copies of remain the same, also they were charged to me the Landlord. Nothing has changed other than monthly payments will now come to my account by dirrect debit.. Any thoughts on this please.
Leaving my letting agents as a landlord .

There's no reason to change the agreements unless there's wording in there that's no longer possible - like who they have to pay rent to or who holds their deposit.
Ideally, even that could be corrected by a simple letter to each tenant confirming what's changed, rather than issuing a new tenancy agreement.
If the deposit is now being protected differently, don't forget about re-issuing the Prescribed Information. When I post, I am expressing an opinion - feel free to disagree, I have been wrong before.
Please don't act on my suggestions without checking with a grown-up (ideally some kind of expert).

I would avoid doing new agreements, unless you know what you are doing. There is a lot of paperwork, which must be done correctly. if it n't done correctly, you may find it hard to get the property back. If you are leaving the letting agency, then you need to make sure you get all the paperwork e.g. contract, deposit, inventory etc.... also do they organise the gas / electric certificate? Do you have support network of tradesmen?
The tenants would have a standing order, rather then direct debits.

Do you have copies of ALL documents from agent that you'd need for an s21?
Will agent keep charging %commisdion after you leave?
Done any training on being s landlord?I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...

Send the T's a letter/email stating that you are no longer using an agent, provide them with your bank details and your contact details. You need to transfer an deposits which the agent was holding into your account, and provide the T's with an new certificate and get them to sign the prescribed information. You should also get all documents (if you don't already have them from the agent, such as gas safety certificates, inventory etc etc).
You should chase up T's to ensure they received the letter, prior to the date on when the payment was due to sent, so to avoid any delays. Some T's don't like dealing directly with LL's and prefer agents, so you may get a few which decide to leave.

Thanks for all the coments I have given the Agency 3 months notice as there terms 1st July I take control, already with the latest tenants just moving in I have done the inventery check and not been charged by the Agent also the deposit will be sent to me we will use DPS for that. We have always been hands on doing all the maitanance required also conducting the viewings to choose tenants that are compatable with other tenants. Our tenants tend to stay for several years it is hoped that the Agents will hand over the previous inventry check info to. Problems arouse with the latest Rightmove advertising info not being good also very poor photos that were dark with the lights switched on, also no EPC info which is a C important at this this time. With the viewings the perspective tenants complained it had taken 2 and a half weeks to book a veiwing . The Agent is now charging around £600 as a letting arrangement fee I will save around £3000 per year on 5 flats not being with the agent we also arranged all the Gas Combi checks and the 5 year electrical testing and EPC. It will be a relief to leave the Agent . I have advised the tenants of the change and all are happy with the change.

by gnvqsosIf private tenants cannot offload problematic tenants, they are in effect relieving the state of their duty to house people. .It is not about strengthening rights. Rather it a strategy that will allow government to abdicate their duty to the poor and the vulnerable. Two birds with one statute.

Reply to Lodger or tenant?by Phil CI think the idea is that income from the lodger will pay most of the bills leaving just the mortgage repayments. And then in 5 years a rethink on selling or staying but as you say, I'm aware myself a lot of landlords are selling rather than buying right now. Personally I just don’t see the point in...

by Phil CDear all
I'd like to ask your options/advice on a situation with a friend.
He is in the process of buying a one bedroom flat and has a plan to rent the bedroom to a lodger and keep the living room locked for himself but not actually live there.
My belief is if...-

by BTL_LandlordThanks for the replies all. It's too much to go into on the forum (would become war & peace!) however yes, in a nutshell, I've gradually lost confidence in their ability to maintain rent payments, let alone the arrears. I heard nothing from them until I served the notice to leave, then low and...

by BTL_LandlordBackground. No rent paid April, May, June so three months arrears. Tenant not good at communicating on this. After a few emails, one or two signed for letters and a notice to leave served, they eventually agreed to recommence rent payments and pay down arrears from 1st July. Apparently rent wasn't...

by JBJ01There should be a clause in the contract regarding communicating with landlords as we're expected to respond the other way, but obviously not in this day and age. It's obvious that a tenant showing increasing disregard to the contract is going to shut down communication to the landlord.

by jpkeatesNot if England follows the Scottish model, if the landlord satisfies the court (Tribunal in Scotland) that they are genuinely planning to sell (which doesn't look very hard), the court doesn't have any discretion.
There's a possible sanction if the property doesn't then get sold....-
