    I'm waiting to see if EPC C actually happens. There are huge swathes of the country with predominantly older housing stock and lower rents which will cost far too much to upgrade if it's even possible. In those areas they will kill the PRS stone dead. Perhaps if they look north of the M25 before legislating...

      Instead, the government intends to introduce a requirement for PRS properties to have an EPC rating of C at change of tenancy from 2025. All PRS properties will then be required to reach a minimum standard of C by 2028. Exemptions will be available for properties where it is not technically feasible or cost effective to reach that standard.

      The government intends to consult during 2022 on requiring all properties in Scotland, regardless of tenure, to meet an EPC standard of C, together with a proposed all-tenure zero emissions heat standard and any legislation needed to underpin this.

      Ex-local authority properties will be a "challenge" I suspect... Energy bills have been a challenge for years in the windy, wet & cold Highlands where I have property....
      I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...

          Of course, they have said no such thing. The government is considering linking mortgages to green home improvements and could impose targets for lenders if insufficient progress is made. So lenders will incentivise (ie give cheaper rates) for those properties with better EPC levels.

              Agree, it will simply be cheaper to obtain a mortgage with an A or B or C rating, but there will still be finance available for the rest, the govt are going to start on the mis information and scare tactics given what they want us to adopt makes no sense..... Heat Pumps etc.

                Funny you should mention that...... watching breakfast tv this morning and a representative of the Green party was on saying how they would fund the extra help needed by the '' poor ''. due to the energy crisis... yep you have guessed it, a one off 1% levy on landlords !!!! per property they own. Pie in the sky i know as they will never get in but it shows how much of a whipping boy we have become.

                  They clearly have no common sense - how much do you think rents would go up if LLs had to pay 1% land tax?! And then when we'd recouped our tax & sold our properties where would the tenants live?

                        Agree, although i am not affected by the scandal i have followed the campaign on Twitter, it all goes to show that this, and previous governments, have not a care in the world about the ordinary person trying to get through life, they do not give a toss.

                          But if the green mortgage scheme is not successful and housing stock upgrade targets are not met then the government is proposing to make it mandatory for lenders to have all properties within their managed portfolios reach EPC Band C by 2030.

                            If the government proceeds with the EPC minimum of grade C this will effectively kill the PRS in large parts of the Country . This will lead to a mass exodus from the sector and a lack of property to rent. This in turn I would expect to lead to significantly increased levels of homelessness. The government has a naive view that tenants will just become house owners, some will but a high proportion simply wouldn't be able to get a mortgage.

                            My hope is that this scenario will at some point become so obvious that the government will step back from this course of action as generally homeless people don't vote.

                              Assuming the EPC change is introduced, it will be interesting to see who will buy the properties being sold off.
                              It won't be landlords, because the properties would require big upgrades to make them lettable, and there's only so much pent up demand from people who can afford to buy but can't find somewhere to purchase.

                              So, prices would have to fall, in order to bring into the market people who can only afford to pay less.
                              So landlords would have to discount quickly so as to be first to sell, before prices drop further.

                                  That's not the same thing, though.

                                  A section 21 notice accelerated possession claim is one that can proceed without a hearing (although that doesn't always happen). It is a specific process that you elect to follow (or not).

                                  as per this blog it is possible If the tenant falls behind with rent, the landlord can repossess the property and cut their losses. After you miss to pay 2 months of rent, the landlord is eligible to use an accelerated possession procedure. If proven the court will grant the order immediately.

                                  There is no accelerated possession with section 8.

                                  I think your solicitor is suggesting using section 21 to obtain possession and then making a separate claim for the money the tenant (presumably) owes.

                                  That would be the advice of many people here, provided that you can serve...

                                  Just bear in mind, when you are served notice, and don't leave, the LL/ LA will then move towards the courts, once this happens all the costs will then be on the T.

                                  Your best solution is to communicate with the LL/LA as well as search for alternative accommodation, you will have up to 2...
