    Annex

    I have a self contained annex, it has kitchen, shower, toilet and own entrance from the alleyway.
    when we bought our house it was already there. It was build with proper planning permission.
    How do I go about renting it out. Washing machine would have to be shares in the main house.
    I emailed council last year, but never heard anything back.
    Whats the proper way going about it?

    Does it have it's own utilities (water, Gas, Electricity) bills and Council tax band? Also does it have its own EPC rating?, You need to look into the aspects concerning your compliance aspects.

    If it is a legal structure then you just rent it out (as long as you have the compliance documents to give to the T).

      The council aren't going to be able to help you.
      You need specialist legal advice, because the annex sounds like a dwelling house, but the shared washing facilities are an issue.

      They introduce a grey area.

        No, all utilities are connect to my main house. What is a compliance document?

              It cannot be (may not be, legally impossible to be) an AST ot AT. Common law tenancy.

              Many landlords, agents, solicitors won't understand this.

              Most tenants won't either.
              I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...

                That's not certain in this case.
                The shared facilities aren't enough to prevent the property from being a dwelling house - washing clothes isn't an essential element of a dwelling house, so it's a grey area.
                The landlord isn't sharing facilities in the dwelling house itself, which isn't helpful.

                I'm not sure of the outcome either way, but the grey area is worrying.
                It would be clearer if the landlord didn't specifically allow the sharing of washing facilities, but possibly not helpful to the landlord's situation.

                  Would the occupant of the annex not be a lodger, rather than a tenant, as it is not a separate dwelling? There are shared facilities.

                    The key element is whether the annex comprises a "dwelling house" or is part of the landlord's property.

                    If there's a lockable door between the annex and the rest of the house (and the key's on the annex side), I'd say the washing machine isn't really a shared space, it's just a washing machine being used by someone who really lives somewhere else.
                    It would be more helpful if it was the other way round and the landlord routinely used space in the annex to do something.

                    With the information available, I'm not completely sure either way, to be honest.

                    The problem is that it would be deciding on the facts by a court if there was a serious dispute, and, until then, I don't think it's black and white, so you'd probably have to treat it as a tenancy just to be safe.
                    Because if you ran it as though it wasn't and a court said it was, you could be in all kinds of trouble.

                          Would it be more convenient and practical for you to just give the annex it’s own washing machine? If there is a kitchen there will be somewhere you can plumb in a washing machine. Then (perhaps) being totally self sufficient it would give you a clear cut answer as to what contract to use eg an AST.

                            I want to rent is as a lodge. having lodgers.
                            i use thr annex, I have stored my staff in the attic.
                            there is not really much room left for a washing machine.
