    Evictions: The “Covid card”

    Hi all ,

    I know it has been discussed before but wondered if anyone had anymore clarity on what happens when tenant plays the “ Iv got a cough, it might be Covid “ card when bailiffs come to evict?

    I have a high court enforcement officer booked in to carry out the eviction on Tuesday and as it stands the person remains in the property today .

    had they had intentions of leaving I’m pretty sure they would have left by know which leads me more to believe that they will look to avoid eviction by claiming Covid symptoms .

    when asked , the high court enforcement agency advised that should the person claim to have COVID symptoms they would call again in 7 days to carry out the eviction however our good friends over at shelter have A step by step process of what happens if you claim to have Covid symptoms on their website and they are clear that Another 2 week notice must then be served .

    If this were to be the case a foresee an ongoing merry go round of bailiff visit - claim symptoms - self isolate for 7 days- have 7 days to “ catch symptoms “ and repeat the whole process again and remain in my property until the law catches up .

    any thoughts or clarity on this matter?

    I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...

      I would have thought that now the bailiff is due, and tenant will know of this he will realise that trying to hang on is pretty fruitless. I agree 'wait and see' but unless you have a really nasty tenant I would expect them to be packing.
      Have they involved Shelter in the eviction process at all?

        I was told by my solicitor my tenant was about “ as bad as it gets” . False allegations to police/ anti social behaviour / harassment via email and text. I fully expect it will not be straight forwards unfortunately, I just hope the 2 weeks notice does not have to be re-issued or I think I am in for a long wait for justice

            I am sure we all wish you well on this forum, and even if you are not affected by ' false Covid ' claims on this occasion, then i think in the very near future some of us will be, canny tenants always catch onto the latest scam to get out of either paying or being evicted, and the ' Covid card ' is a gift from heaven for the feckless.

              Hi, can I asked what happened with this?
              last Wednesday our tenent threw an isolation letter out the window to our court baliffs. They have made a date to come back 14days later but who says he isn’t going to say same thing again. Baliffs don’t have an answer to what they will do if this is the case?!

                Willgetthereintheend,

                Unfortunately i fear that you (and others in the weeks to come) are the canaries in the mine for the Covid Scam. I cannot see how any LL on this forum could give you an answer based on certainty of any kind.

                  That sounds like unbelievably efficient bailiffs. Were they high court or county court?
