    Rolling / Periodic Tenancy

    Hi all, I hope you have been able to enjoy the sunshine this week.
    My flat is rented out using an assured shorthold tenancy agreement of 12 months, the 12 months ends in August this year. It is rented out through a local estate agents using their 'rent & collect' service. The agent has asked me to check with the tenants whether they want to renew the contract for another year or terminate their contract.
    If the tenants want to stay is it possible to just switch to a rolling month by month periodic tenancy? I have not been given this option by the agents. We may (try to) sell the flat in the next 12 months so I am keen not to be locked into a 12 month tenancy.

    I am still a fairly new landlord so apologies for the basic question

    Yes, unless the tenancy agreement says otherwise, a new periodic tenancy will begin when the fixed term ends.

      I suspect that as their are no fees payable on renewal by the T's the agents want to keep their commission from you on the limited service they are providing if they are not managing the tenancy.

      You would need to see what your contract is with the LA as to see if can terminate their involvement.

        I think the NTQ may be your best option. The tenant could defeat it by returning to live there but that would at least enable you to get the rent payments reinstated. If they dont return, the tenancy will end. You can serve the notice at the property, but make sure its also sent to wherever the tenant...

        I based mine on an old RLA template. I think NRLA still have one. You could try that....

        Your questions are too wide ranging for a forum. The answers would form a long article. Asking questions on here is not a substitute for reading. I suggest you join the NRLA and read all their guides and checklists....
