    Changing AST when tenant moves out

    Hi, I’d be grateful for your advice on the best way forward. Our tenants are a mother, 2 adult daughters and one child. The eldest daughter is getting married and moving out. She and her mother currently split the rent as the mother’s salary wouldn’t cover the entire rent. The eldest daughter is going to continue contributing towards the rent when she moves out.

    The mother and eldest daughter are the named tenants on current tenancy agreement (the 2nd daughter was a minor when they moved in). Can we continue with the same tenancy agreement even though one has moved out?

    The other option would be to issue a new AST with the mother and 2nd daughter as named tenants and the 1st daughter as a guarantor.

    Does anyone have a view which would be the better option?

    Leave it as it is - the daughter is still responsible as she is named on the tenancy. If the tenants want to change it then treat it as a new tenancy & do all appropriate checks - if they don't meet the affordability criteria don't rent to them. Harsh - but necessary.

        Agreed. Best in this scenario to leave it. The daughter will still be a tenant and legally liable for the rent. If she wants to get out of that situation she would have to serve notice, which would also end the mother's tenancy, so she has good incentive to pay.
