    ‘Swapping’ a tenancy?

    Hello,

    Just wanting to check something. If a long standing tenant on a periodic tenancy agreed to move to a different property to suit the landlord, would a completely new six month AST with all appropriate documentation need to be set up? And would the deposit for the existing property have to be released to the tenant, and a new deposit protected for the other property?

      Much, much MUCH! safer to surrender old tenancy & agree news AST, all paperwork etc etc etc (deposit, EPC, inventory, photos....)
      I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...

        Thank you, that’s what I thought. I’m the tenant here, and my landlord seems to think we can just do it by agreement? While there’s a lot of goodwill on both sides, and I don’t see that changing, I still think it would be better for both parties to have everything properly and legally set out?

          Oh, agree to it. Landlord will have ****ed up paperwork and likely be unable to evict. Wonder what else he's already got wrong

            I would write the discrepancies on the inventory and then sign it and return it. Keep a copy for when you move out.
